Better economic growth likely to follow weak Q2

WASHINGTON (AP) ? The economy is expected to have grown at a dismal pace in the April-June quarter, weighed down by large tax increases and steep government spending cuts.

But the second quarter should be the low point for the year, economists say. The fiscal drag is expected to fade. At the same time, steady hiring, more business spending and a solid recovery in housing should push growth higher in the second half of the year.

Economists forecast that growth slowed in the April-June quarter to a seasonally adjusted annual rate of just 1 percent, according to a survey by FactSet. That's below the tepid rate of 1.8 percent in the January-March quarter.

The Commerce Department will release the first estimate of gross domestic product, or GDP, for the second quarter at 8:30 a.m. EDT Wednesday. GDP is the broadest measure of the output of goods and services, including everything from manicures to industrial machinery.

Most economists say growth is already starting to pick up. And many are predicting annual growth rates of between 2 percent and 3 percent in the third and fourth quarters.

There are threats to the better outlook. Unemployment is still high at 7.6 percent, limiting consumer spending. And budget fights in Washington could lead to a government shutdown this fall, potentially disrupting the economy.

Still, recent data have been encouraging.

"More and more of the economic tea leaves are pointing in the same direction: toward a growth revival ahead," Scott Anderson, chief economist at the Bank of the West, said.

Home construction, sales and prices have been growing since early last year. Americans purchased newly built homes in June at the fastest pace in five years. That's raised builder confidence to a seven-year high, which should lead to increases in construction and more jobs.

Overall hiring has accelerated this year. Employers have added an average of 202,000 jobs a month from January through June. That's up from 180,000 in the previous six months.

Better hiring has started to boost inflation-adjusted incomes after several years of stagnant wages. Joe Carson, chief U.S. economist at AllianceBernstein, a mutual fund company, calculates that average hourly pay rose at a 3.1 percent annual rate in the second quarter, the fastest pace since the fourth quarter of 2008. That was comfortably ahead of inflation, at just 1 percent.

And business spending has started to increase. Companies have ordered more industrial machinery and other equipment for four months in a row. As those orders are filled, factory production should increase.

Manufacturing is also benefiting from strong auto sales, which topped 7.8 million in the first six months of 2013, the best first-half total since 2007. Analysts expect sales will stay strong for the rest of the year.

Carson notes that housing and autos were the primary sources of growth in the second quarter. Both have benefited from the Federal Reserve's low-interest rate policies. Those sectors usually rebound early in recoveries. But after the Great Recession ended in June 2009, they were held back by tight credit and cash-strapped consumers.

"It's almost like a traditional recovery is just starting, even though we're in the fifth year," Carson said.

Federal Reserve officials have forecast better growth in the second half of the year. And Fed Chairman Ben Bernanke has said that the central bank could begin to scale back its bond purchases later this year if the economy strengthens. But Fed officials typically put greater weight on employment and inflation data than the GDP figures.

The Fed concludes a two-day policy meeting on Wednesday, at which point it could clarify its interest-rate policies.

Most economists blame tax increases and government spending cuts for the sluggish second quarter. Higher taxes slowed consumer spending. And government cuts subtracted nearly a full percentage point from growth at the start of the year.

Even so, the solid pace of hiring suggests the economy is doing better than the growth figures show. Tax receipts have been stronger. Faster growth in the second half of the year would help close those gaps.

The government is also expected to release comprehensive revisions on Wednesday. Roughly every five years, the department incorporates more recent data and adjusts how it calculates GDP.

The revisions will likely show growth was faster in the first quarter and last year than previously estimated, economist say. Michelle Meyer, an economist at Bank of America Merrill Lynch, estimates the revisions could add up to a half-point to last year's 2.2 percent growth rate.

The revisions will also alter GDP data all the way back to 1929. In one major change, the government plans to count spending on research and development as investment, rather than as a regular cost of doing business. That, along with other changes, will boost the level of GDP in 2007 by about 3 percent, or $450 billion. It isn't likely to significantly change the pace of growth in recent years.

Football mourns Chucho as former Birmingham striker Christian Benitez dies aged 27

Benitez, a father of three-year-old twins, died after reportedly suffering a cardiorespiratory arrest, less than a month after signing for Qatari club Al Jaish.

Manchester United winger Antonio Valencia, an Ecuador team-mate, tweeted a picture of the pair together and wrote: ?Why now brother? This strong pain you?ve caused me will stay forever my brother, but we love you. Please brother. Someone please say no.?

Benitez was admitted to hospital with severe stomach pain hours after making his debut against Qatar Sports Club in the Sheikh Jassem Cup on Sunday but died shortly afterwards.

Fabrice Muamba, the former Bolton midfielder who suffered a cardiac arrest on the pitch at White Hart Lane in an FA Cup tie with Spurs, wrote on Twitter: ?My thoughts and prayers are with his family.?

Benitez was on loan at Birmingham in the Premier League during the 2009-2010 season and the club will pay tribute to him ahead of Saturday?s match at home against Watford.

The Ecuadorian, who had 58 caps, was in the squad for World Cup finals in Germany in 2006 and had scored 24 times for his country.

During his loan from Mexican club Santos Laguna, he turned out 36 times for Birmingham and scored four goals.

Alex McLeish, who was his manager at Birmingham, told Sky Sports News: ?He was a very likeable guy and dangerous in the box.

?I would have kept him but he went because we were trying to bring in some top players.

?That did not materialise and I was left cursing the fact we could?ve kept him for that season because I?m sure he?d have flourished in England.?

Sunderland midfielder Craig Gardner, who played with Benitez at Birmingham, wrote on Twitter: ?Can?t believe Christian Benitez aka chucho has died had the pleasure to play with him he was a top bloke.?

West Brom?s former Birmingham defender Liam Ridgewell tweeted: ?Such a sad thing. Had a great year with him at Blues. Sad time.?

In a statement, Birmingham said: ?The thoughts of all associated with the football club are with Chucho?s family and friends at this very sad time. He was an immensely popular character during his time at the club.?

Qatari club El Jaish confirmed the news in a statement: ?His sudden departure is a big shock.

?He was a player that over the short period he was here was regarded for his high moral character.?

India's Congress Party agrees to create new state in south

NEW DELHI (Reuters) - India's ruling Congress party approved on Tuesday the creation of a new southern state, a move that has revived deep political divisions and raised fears of violence in the area, home to global firms including Google.

The decision to break up Andhra Pradesh state and establish Telangana comes ahead of elections next year and critics say the ruling party is seeking to shore up its political fortunes after dragging its feet over the explosive issue for four decades.

Supporters, however, say Telangana's economic development has been neglected in favor of the richer and more powerful Andhra region, and that a new state is the only solution.

"It was not an easy decision, we appeal to people to cooperate," said Ajay Maken, a spokesman of the Congress after the party's highest decision-making body adopted a resolution calling for the establishment of a new state, igniting celebrations in parts of Andhra.

Additional federal troops were deployed ahead of the decision in the coastal parts of Andhra Pradesh where people are bitterly opposed to the breakup of the state.

The booming state capital Hyderabad, where Google, Microsoft and Dell have major sites, will remain the common capital for two states for a period of 10 years, Maken said.

Hyderabad, India's sixth largest city, was a bone of contention because it fell in the proposed new state carved out of the western part of Andhra Pradesh.

A government official said there was still a long way to go before the new state, which will have an estimated population of 40 million, became a reality. The measure has to be approved by the Andhra assembly and then the federal parliament where the Congress does not have a clear majority.

"We're swallowing the poison for our party. The decision is very unfortunate but since our leader has taken the decision we'll abide by it. We know the consequences, the problems that will follow," said Rudraraju Padma Raju, the chief whip of the Congress in the state, who has long opposed the split.

"DANGEROUS TREND"

One immediate consequence is likely to be renewed demands from other parts of India for separate states, including in the Darjeeling hills and a further breakup of the most populous Uttar Pradesh state.

Since independence in 1947, successive governments have dealt carefully with demands for new states - creating three in 2000 - while ensuring demands did not spiral enough to threaten the integrity of a nation that now has 1.2 billion people with hundreds of languages, ethnicities and castes.

India currently has 28 states while the United States with a population of 300 million has 50.

The chief minister of revolt-torn Jammu and Kashmir state said he feared the establishment of Telangana would set off more unrest.

"Telangana is a state that will be created on the basis of agitation. It's not created on the basis of any recommendation of a state reorganizing commission or something like that," said Omar Abdullah.

"I believe this is a dangerous trend because all we are doing is sending across a message that if you agitate enough, and if you agitate long enough, you will create a state."

Another fear is that leftist guerrillas who operate in parts of the proposed Telangana state will become further emboldened and take advantage as the new state comes into being.

Breast cancer survival is three years shorter for black women compared with white women, mostly because their cancer is often more advanced when they first seek medical care, new research shows. Cancer researchers have known for two decades that black women with breast cancer tend to fare worse than white women. The findings, published in the Journal of the American Medical Association, suggest that while a significant number of black women still get inferior cancer care, the larger problem appears to be that black women get less health care over all, and that screening and early detection campaigns may have failed to reach black communities. "We are getting there too late. That's why we are seeing these differences in survival," said Dr. Jeffrey H. Silber, the director of the Center for Outcomes Research at the Children's Hospital of Philadelphia.

How Google Glass Development Will Boost Android Phones

The best argument for funding the space program is: ?Because space, that?s why!!?

But for many this argument is pointless. They would prefer the money be spent to help people on Earth. And for those folks, the best argument is: ?Space missions always invent numerous technologies that make life better for everybody.? NASA even maintains an online database/magazine called Spinoff to keep track of these technologies, which average about 50 per year.

A similar phenomenon is likely to happen with Google Glass, which is not only a wearable computing hardware device, but also a development platform.

I?m predicting that Google?s massively well funded moonshot, the beta product formerly known as the Google Glass Project, will bring to Android phone and tablet users incredible technologies, ideas, apps and content originally developed for Glass.

A couple days ago, Googler Alain Vongsouvanh from the Glass team, posted this entreaty for Glass developers waiting for the Glass-specific GDK (Glass Development Kit) to go ahead and use the existing Android SDK to start building Glass apps.

That?s great advice. Getting started using Android will accelerate the development of Glass apps. But even better is that developers now and later will discover that their Glass ideas will also make great Android apps.

Glass development comes with it numerous constraints. It?s got only a 640?360 resolution screen. Battery conservation is absolutely paramount. Interrupting the user must be reserved only for the most vital information. The user interface is cards.

Developing under all these constraints will result in small-footprint, battery-conserving, card-interface apps, which will be awesome on big-screen, big-battery Android smartphones and tablets.

We?re already seeing a similar phenomenon happen elsewhere.

If you heard about the recent launch of the Motorola Droid line (on Verizon only).

The phones are made totally different and better by an X8 system-on-a-chip, which includes some very bleeding-edge low-power features. One of these is that the time and notifications fade into view with a low-rez font powering just a fraction of the screen. Another is that the chips constantly check for location data and other contextual data without using much power.?Upcoming Moto X phones are also rumored to have these features.

These features may have never been developed for phones. They were in fact necessary technologies for the development of Motorola?s smartwatches. (It?s not clear whether the development was for past or future smartwatches, but make no mistake: This is spin-off technology from the smartwatch group.)

So let?s be clear about what?s going on here. It?s very likely that the technology that make Motorola phones better than many other phones (possibly all other phones ? who knows?) is technology first developed for wearable devices.

Another way to understand this is that Motorola is evolving its smartphones not only using wearable technology, but with wearable functionality and wearable use-cases. They behave like wearable computing devices and in doing so are improved as phones.

Another example is Google Now and the ?card? interface being applied to Google+ and other sites. It?s a near certainty that Google has been strongly influenced by the coming age of wearable computing in the design of services that will be used on all platforms. Google Now in particular is especially well designed for wearable computing. And all that over-simplification, performance optimization and other qualities that make Google Now work great on Google Glass are the same qualities that make it awesome on your phone, tablet and soon in your Chrome browser as well.

This is what?s going to happen with Google Glass. An army of Glass developers will create app types designed for the limitations and opportunities and use-cases of Google Glass. And these same apps will transform how Android phones work.

Let me give you one small example. It?s almost certain that someone ? possibly Google itself ? will create a ?subtitles? app for Glass. You?ll set the language to ?Italian,? then when people in real life are talking to you in Italian, you?ll see the English subtitles in Glass.

Once somebody creates a subtitles app, it?s a trivial leap to add that to a video capture app on Android. Video somebody talking italian, and the subtitles will be simultaneously printed on your video in real time, so that when you upload your video to YouTube the subtitles are already there.

Now that I?m wearing Google Glass all the time, people always ask me: What can it do?

Imagine being asked that question about smartphones in the year 2000. You would never have been able to predict the million things people now do with smartphones, mainly thanks to apps.

Likewise, nobody can predict where apps will take Google Glass. But we can predict that wherever Glass goes, so goes Android.

Pope celebrates Mass in Rio aimed at bishops

RIO DE JANEIRO (AP) ? Pope Francis is celebrating Mass in Rio de Janeiro's massive cathedral as he begins the culminating weekend of his first international trip, to the church's World Youth Day.

An estimated 1,000 bishops are celebrating the Mass along with Francis and his message is expected to echo what he has told young pilgrims all week: Go out of your churches to the peripheries and spread the faith to society's outcasts.

Francis faces a busy Saturday: After Mass, he goes to Rio's municipal theater to meet Brazilian politicians, businessmen, intellectuals and the diplomatic community. Afterward, he lunches with the country's bishops and then presides over an evening vigil on Copacabana beach that is expected to draw over 1 million young people.

He returns to Rome on Sunday after the final Mass.

Newly retired Apolo Ohno to work in TV at Olympics

BEVERLY HILLS, Calif. (AP) ? Apolo Anton Ohno is hanging up his skates to join NBC's coverage of the 2014 Sochi Olympics.

The most decorated U.S. Winter Olympian in history will work as an analyst on speedskating, in addition to doing features and studio commentary during the network's coverage in February.

Ohno says he may also contribute to NBC's coverage of Alpine skiing and snowboarding in Sochi, Russia.

"Hopefully I can give people a good show," he said Saturday at the Television Critics Association meeting.

Ohno recently retired without fanfare, although he hadn't competed since the 2010 Vancouver Games. He won eight medals in three Olympics.

"I miss it every day," he said.

At the same time, Ohno said, "I don't want to get in that skinsuit."

He first worked for NBC at last year's Summer Olympics in London, giving him a view of the action from the seats.

"That was my most difficult moment because you feel like you can do it one more time," said Ohno, who first thought after his last race in Vancouver that he might be done competing.

Ohno said being an ex-athlete will help him relate to the people he covers in ways that his media colleagues cannot.

"I've lived it. I've been there day in and day out," he said. "I can share that and gain that trust with other athletes."

Ohno said he won't have a problem asking tough questions.

"You have to," he said. "At the end of the day I have a job."

The 31-year-old skater is living full time in Los Angeles to take advantage of entertainment opportunities that have materialized since he broke out as a star at the 2002 Winter Olympics.

"Olympic athletes have to find a job right after they're done competing," he said.

In June, he started hosting a new version of "Minute to Win It" on the Game Show Network. He earlier raised his pop culture profile by winning a season of "Dancing With the Stars."

"You'd like people to remember you for these great times on the ice," he said. "In reality, you want them to forget because you're doing something new and better. This is the new me."

Shooting Star Basketball Camp a Win-Win for NBA Players, Local Youths

Three NBA basketball talents with ties to Santa Barbara gathered more than 60 youths for the first Shooting Star Youth Basketball Camp held at Bishop Garcia Diego High School.

Kids laced up their shoes and took to the hardwood for the clinic that included instruction and mentorship from the pros ? Julyan Stone, a graduate of Dos Pueblos High School who recently signed with the Toronto Raptors, joined by UCSB alumni Orlando Johnson of the Indiana Pacers and James Nunnally of the Bakersfield Jam, who recently played for the Miami Heat summer league team and is fourth on UCSB?s all-time scoring list.

The three-day camp taught kids the fundamentals of basketball ? dribbling, shooting, passing and defense ? with one-on-one instruction, interactive lectures, scrimmages and group competition.

?Besides the skills, the message of our camp is that whatever you dream of is a possibility, and we just want to install that in the kids,? said Stone, who founded the camp along with Johnson and Nunnally.

Stone added that the camp gave these three longtime friends an opportunity to give back to the community and inspire a new generation of kids to excel in life regardless of their circumstances.

?We all came from similar backgrounds and started with little or nothing, and were able to make it here now matter what and get through adversity,? Stone said, ?so that?s our main message to the kids.?

It was apparent from the smiles on the kids? faces as they raced up and down the court that taking cues from their coaches was not only fun but also increased their self-confidence, an important attribute that would translate both on and off the court.

?I love it,? Johnson told Noozhawk after a Q&A session with the kids. ?It excites me because these kids, you see how eager they are to learn and you really get their attention and they are looking at you like what?s he going to do next? I?m really happy to be out here and to help these kids and give all the talents I was blessed with to help them and try to encourage them.?

On the last day of camp, kids munched on burgers and hot dogs at a barbecue-style luncheon, where they posed for pictures and lined up for autograph signings and prizes from the group of elite basketball players ? who acted as friends, coach and mentor during the camp.

The NBA players gave away 30 scholarships to the United Boys & Girls Clubs of Santa Barbara County to ensure that youths from low-income families also have the chance to experience the unique camp.

An overwhelmingly positive response to the event gives organizers hope that this is the first of many camps to come for Santa Barbara-area kids.

?This is not about money for us. We just want them to have a good experience. We weren?t always able to afford the expensive camps, so that?s why we are doing this,? Nunnally said. ?We want them to have an experience that they will remember.?

Camp sponsors included Camp Spins, Pepsi, Frito Lay, Subway in Isla Vista, Gatorade, Goleta Signs, Teen Sports Radio and Nike.

Additionally, a local teen was awarded a $2,0000 scholarship based on a 500-word essay, titled ?How High School Athletics Has Impacted My Life,? describing the youth?s college academic goals and athletic aspirations. Stone, Johnson and Nunnally unanimously selected the winner of the award designed to help the youth succeed in academic pursuits and become an effective leader within the community.

On Friday night, the three players joined other professional players to battle the Santa Barbara Breakers at San Marcos High School for the Mid-Summer Benefit Game benefiting the local Boys & Girls Clubs as well as the Santa Barbara Basketball Hall of Fame College Scholarship Fund.

On July 25th JoVE, the Journal of Visualized Experiments will publish a new technique that will help scientists better understand the genes that govern food-related behavior in honey bees. The impact of this study could take scientists one-step closer toward understanding and perhaps changing undesirable food-related behavior in humans via gene control.

"Our technique has already helped to unravel [the] complex gene networks behind biological processes and behavior, such as gustatory perception," said Dr. Ying Wang of Arizona State University. She and a team of scientists are behind the experiment, titled RNAi-mediated Double Gene Knockdown and Gustatory Perception Measurement in Honey Bees. "Honey bees are much less complex than mammals and humans, but [we] share many major genes," said Wang, "therefore, honey bees have become an emerging system for us to understand food related behavior in humans."

In Wang's previous study, she found that carbohydrate metabolism and insulin pathway genes were involved in honey bee gustatory perception. Her new article introduces two strategies for targeting and simultaneously down-regulating multiple genes in honey bees via RNA interference. This allows for further research in examining the role of insulin metabolism in gustatory perception. The team believes it will be important to understanding how insulin pathways play a role in food-related behavior.

Wang's multiple gene knockdown method is a first in entomology, and it overcomes the many shortfalls associated with typical single-gene targeting methods. A common problem associated with single gene suppression is that it is not sufficient to show the interrelationship of a gene network.

In the article published today, Wang's team has also provided a technique to measure the resulting changes in honey bee behavior, and this has led them to interesting observations. "Gustatory perception is a behavioral predictor for honey bee social behavior," said Wang. A honey bee's sensitivity to sugar predicts the food-choices and timing of foraging.

Wang's experiment opens the door for researchers to build upon her lab's techniques. "We believe our double knockdown approach will be more recognized and shared in the field when it is published in the video journal JoVE," said Wang.

With any luck, the impact will result in more than just high-tech pest control. It could instead provide insight into human insulin pathways, potentially giving us an opportunity to learn how to control human dietary behavior.

Judge orders more than $1M to be returned to exotic dancer

A federal judge in Nebraska ordered the government to return more than $1 million to a California exotic dancer who says she saved the money one dance at a time.

The ruling came in an opinion last week after federal authorities claimed at trial the money --?$1,074,900 --?was the product of illegal drug sales.

On March 3, 2012, Nebraska State Patrol Trooper Ryan Hayes pulled over a couple ? Rajesh Dheri and his wife, Marina ? on Interstate 80 near North Platte for driving 93 mph in a 75-mph zone.

Hayes questioned the couple as to where they were going. Dheri explained they had rented the Mercedes SUV in Los Angeles and were driving back home to New Jersey with various stops to visit friends and family.

Before he let the couple go, Hayes asked them if they had anything illegal in the car. The couple said no and agreed to let him search it. He found a duffel bag lined with dryer sheets and stuffed with rubber-banded bundles of $100 bills totaling $1,074,90, according to court documents.

Hayes detained the couple and brought them to Nebraska State Patrol where a drug dog indicated the ?odor of controlled substances emanating from the currency," the official complaint said.

The Dehris said they were taking the money to New Jersey for their friends for a business deal involving a nightclub.

The U.S. Attorney?s office argued that both the amount of money and the way it was stored was indicative of drug trafficking.

Tara Mishra, the Dheri's friend, testified last month at a bench trial in Omaha that she earned the money as an exotic dancer and had given it to the couple to invest.

In his ruling, Judge Joseph F. Bataillon said the canine alert held little weight in the case because the government offered no statistical support to back it up.

"For all the court knows, there is a 90 percent chance that all money is drug tainted," the judge said, but the?government "left too many unanswered questions and had a general failure of proof in this case."

The money, plus interest, was ordered to be returned to Mishra.

Dell founder ups takeover bid based on voting rule change

(Reuters) - Dell Inc founder Michael Dell raised his $24.4 billion bid by less than 1 percent just hours before it was to be put to a vote, tacking on a controversial demand to change voting rules to make it easier for him to buy and take the No. 3 personal computer maker private.

A special board committee on Wednesday was reviewing the CEO's sweetened $13.75 offer and requirement that a majority of votes cast be enough to seal the deal, an easier threshold for him to meet.

But the committee wants at least $14 per share to even consider that change in voting terms, a person familiar with the matter said. And Silver Lake, which is backing Michael Dell's now roughly $24.6 billion bid, will not back an increase to $14, said a second person familiar with the matter.

The vote on the buyout was postponed for a second time, to next Friday, to give investors yet another week to consider. The first vote had been slated for July 18.

Michael Dell's unusual demand sparked outrage among major investors and is likely to incite aggressive legal challenges, law experts say. His offer now requires a majority of all shareholders' votes, a difficult bar to meet because about a quarter of shares have not been voted either way, which then count as votes against him.

Activist investor Carl Icahn, who has amassed an 8.7 percent stake in Dell and is leading a charge with Southeastern against the buyout with an offer of his own, tweeted on Wednesday that "all would be swell at Dell if Michael and the board bid farewell."

"The latest change is a "transparent attempt to force their freeze-out transaction across the finish line despite the vote of its stockholders," Icahn said in a subsequent statement.

The sweetened offer, which Michael Dell and Silver Lake called their best and final proposal, comes after the group refused for months to consider a raised bid despite growing opposition from Icahn and other shareholders.

Richard Pzena, founder and co-chief investment officer of Pzena Investment Management, which owned 0.73 percent of Dell's outstanding shares at the end of March, called the proposed change in shareholder voting rule "outrageous".

"Certainly the 10 cents wouldn't sway anybody so they have to change the rules, and if the special committee goes along with this, it would be a travesty," Pzena said.

A THORNY ISSUE

Experts say the CEO's attempt to change the voting rules is legal but almost certain to get challenged in court, where there's been little precedent.

While trying to change voting provisions with a raised bid is uncommon, similar tactics have been employed by other companies in the past when investor support was lacking.

OSI Restaurant Partners Inc., owner of the Outback Steakhouse chain, was bought by Bain Capital Partners and few of the OSI management in 2007 after the group bumped up their offer price and changed the voting requirements. That case, which is not directly comparable because it involved excluding the founder's and management's shares from the vote, was challenged in Florida and Delaware courts and dismissed.

But Brian Quinn, a professor at Boston College Law School who runs the M&A Law Prof Blog, said that Michael Dell and Silver Lake may face a higher burden of proof in court.

"When the lawsuits, of which there are many, proceed the board won't get the protection of business judgment but will have to prove fairness," he said.

Fairness puts the burden on the board to prove the price and process were fair. Business judgment is much more management friendly and puts the burden on plaintiffs to prove there were conflicts of interest or lack of good faith.

"That's a big wrinkle," he said.

Dell shares closed up 0.3 percent at $12.92 on Wednesday.

"According to our latest tally, approximately 27 percent of the unaffiliated shares have not yet been voted. The presumption that these shares should be treated as if they had voted against the transaction is patently unfair," Michael Dell and Silver Lake said.

The votes that have come in so far are split evenly between yes and no, according to people familiar with the matter. That means those who abstain from voting can determine the outcome.

The buyout group believes it can get the votes to pass the deal if Dell will count just the shares that have been voted. The provision of counting non-votes as a "no" was accepted reluctantly by the bidders as it sets a very high threshold to meet, according to one of the sources.

Another investor said the new offer is not really a bump.

"This is not about how to win the deal, this is about how Michael Dell exits the process," said the Dell investor, who requested anonymity. "They're really putting the screws on the special committee but I don't see how the special committee can accept the conditions."

NCAA requests that Paterno family lawsuit be dismissed

In a release, the NCAA has requested the lawsuit filed by the?estate of Joe Paterno and others in late May be dismissed ?due to a lack of legal standing, a failure to add necessary defendants, and various significant legal deficiencies.? The request comes a year to the day after?NCAA president Mark Emmert was given unprecedented authority to?levy numerous sanctions against Penn State?in the aftermath of the Jerry Sandusky scandal and the Freeh Report which followed.

The Paterno family?s lawsuit claims, among other things, that Emmert and the NCAA essentially?forced Penn State?s hand into signing a consent decree for sanctioning based on the Freeh Report. By doing so, the plaintiffs believe the NCAA failed to follow its own rules. The Association, as one would expect, objects to that line of thought.

?Penn State leaders determined the consent decree was the best course for the university and its community to put the devastating Sandusky affair behind them,? Donald Remy, the NCAA?s?Chief Legal Officer, writes.?Those who continue to challenge Penn State?s right to make that decision only prolong the pain and delay the recovery.?

A judge already dismissed a case filed by Pennsylvania Gov. Tom Corbett?which?asked for the NCAA sanctions to be overturned. While the Paterno family suit seeks some similar results, it?s nearly impossible to tell if it will wind up with the same fate as Corbett?s suit.

White House seeking clarity on Snowden's status

WASHINGTON (AP) ? The Obama administration said Wednesday it has asked Russian authorities to clarify the status of National Security Agency leaker Edward Snowden, and restated its desire to see him returned to the United States.

A state news agency in Russia said Snowden has been given a document allowing him to leave the transit zone of a Moscow airport. But Snowden's lawyer later said his client's asylum status has not been resolved and that Snowden will stay at the airport for now.

State Department spokeswoman Jen Psaki said Secretary of State John Kerry called Russian Foreign Minister Sergey Lavrov to reiterate "the belief of the United States, that Mr. Snowden needs to be returned to the United States, where he will have a fair trial; that Russia still has the ability to do the right thing."

She said Kerry told Lavrov that the U.S. would be "deeply disappointed" if Russia made any effort to facilitate his movement out of the airport, or to any destination other than the U.S.

"Obviously any move that would allow Mr. Snowden to depart the airport would be deeply disappointing," Psaki said.

Snowden has been marooned in the Moscow airport since June 23 on a flight from Hong Kong. Snowden has applied for asylum in Russia after agreeing to a demand by Russian President Vladimir Putin that he stop leaking information as a condition of remaining in the country.

White House spokesman Jay Carney said the administration has made clear to the Russians its desire to see Snowden returned to the U.S. to face espionage charges. Carney had no updates on how Snowden's status might affect President Barack Obama's plans to travel to Russia in September.

Snowden "is neither a human rights activist, nor a dissident," Carney said. "He's been charged with serious felonies for the unauthorized leaking of highly classified information, and there is ample precedent and legal justification for him to be returned to the United States where he will face trial with all the rights and protections afforded defendants in the United States of America."

Credit Union now open in new Wal-Mart Neighborhood Market

BRISTOL ? Nutmeg State Federal Credit Union has opened a branch in the new Wal-Mart Neighborhood Market.

While bank branches in supermarkets are nothing new, Nutmeg State is the first credit union in the area to have a location in a store. The new location is also Rocky Hill-based Nutmeg State?s first foray into the Bristol area.

?This is another area we needed to be in,? said John Holt, CEO of Nutmeg State. ?We have a lot of members in Bristol.?

The credit union has locations in nine towns, including Rocky Hill, where its headquarters are located, New Britain and the Price Chopper in Newington.

Holt said credit unions, because of their structure, offer higher interest rates on bank accounts, lower account fees and lower interest rates on loans.

The Wal-Mart branch, with just 600 square feet of space, offers all the services that the full-size branches do.

?You can open an account, take out a loan, get a mortgage or home equity loan,? said Holt.

Several credit union employees were eagerly promoting the new branch in the store Friday, giving out balloons to kids and offering customers free cupcakes.

Quiria Little, who lives in New Britain and works in Bristol, was drawn in by the cupcakes and was soon talking to branch manager Lila Winiarski. Within 15 minutes, Little had made plans to consolidate her money, which has been distributed among several banks, into an account at Nutmeg State Federal Credit Union.

?I can shop and do my banking in one place,? she said. ?That?s pretty cool. I just bought a house, so this will help me keep track of all my bills and have all my money in one spot.?

From now until Aug. 10, those who open a ?More Than Free? checking account with full direct deposit in the Bristol branch will receive $50.

The Nutmeg State Federal Credit Union branch is located in Wal-Mart Neighborhood Market at 325 Oakland St. It is open from 9 a.m. to 7 p.m. Monday through Friday and from 9 a.m. to 3 p.m. Saturday.???

Union members 'divided' on Labour

Just 12% of Unite members would sign up as full Labour Party members, new polling from Lord Ashcroft claims.

The former Tory party deputy chairman said just 30% of Unite members would opt in to funding Labour if reforms to the way the political levy is operated went through.

Less than half (49%) said they would vote Labour if an election were held tomorrow, compared to 23% Conservative, 7% Liberal Democrat and 12% Ukip. At the 2010 election 40% voted Labour, 28% Conservative and 20% Lib Dem.

Labour leader Ed Miliband has proposed ending the automatic opt-in of union members which is currently a major source of funding to his party.

This is largely about policy. But the policies he himself advocates seem unlikely to have the desired effect. McCluskey is quite right that his members are not queuing up to join Labour. And if Miliband takes his advice, nor will they."

The poll interviewed 712 Unite members from a total membership of 1.42 million. Questions were posed online between July 10 and 17. Other findings of the poll suggested 30% of Unite members already opted out of funding the Labour Party, while a third did not know whether they did or not. Most Unite members, 57%, supported the idea of an opt-in system.

The union's membership was divided over whether Unite had been right to give nearly ?12 million to Labour since the general election, with 46% disagreeing but 43% backing the donations. Almost half, 49%, said future large donations would be wrong.

Unite members were more likely to think the Labour Party did a bad job of representing ordinary working people (47%) than think it did a good job (42%). And a large majority of 86% of members backed the Government's policy of a ?26,000 a year benefit cap.

Mr Miliband said: "I think this poll is proving that we are right to want change, because there are people who want to be part of our party, want to be active members of our party, want to be affiliated to our party. I want to give that that choice and I want to make it a real choice."

If 12% of individuals currently affiliated to Labour through their unions signed up to become full members, that would double the size of the party membership, he pointed out.

Mayor: Cleveland suspect 'idolized' local serial killer

Three bodies have been discovered in East Cleveland, Ohio, police say, and a man is in custody in connection with the case.

"We are dealing with a sick individual, and we have reason to believe that there might be more victims," East Cleveland Mayor Gary Norton told CNN.

All three victims appear to be young black women, their decomposing bodies wrapped in layers of plastic and taped up, according to authorities.

Two bodies were found Saturday, one in the basement of an abandoned house, the other in a field nearby. The first victim was found Friday in a garage on the same block after police received a call about a foul odor.

The first victim was found naked with indications of trauma, police say. The second victim was found wearing a green hoodie, and the third was wearing a leopard print leotard.

The garage where the first victim was found was leased to Michael Madison, according to Detective Sgt. Scott Gardner with the East Cleveland police.

Authorities obtained a search warrant for Madison's apartment and found "additional evidence of decomposition" there, he said.

The 35-year-old suspect was later located and taken into custody without incident after a standoff at his mother's house.

According to police, Madison was convicted of attempted rape in 2001 and is a registered sex offender.

CNN could not immediately reach a representative for Madison.
